Special provisions for using the web application from Engineering Maps UG (limited liability)
These special provisions apply to the Engineering Maps app (hereinafter referred to as “app”) and the Engineering Maps web portal (hereinafter referred to as “portal”) published by Engineering Maps UG (limited liability). By confirming the terms of use before using the app and the portal or when using the app or the portal in general for the first time, you (user) immediately agree to the provisions. If you do not agree to the general terms of use, you should not use the app or the portal.

Legal information
By accessing the information, services, competitions made accessible with the app or the portal and using the content and functions (hereinafter referred to as “information and functions”), the user expressly agrees to the following special provisions. Otherwise, the user refrains from using the app or the portal and from accessing the information and functions. Engineering Maps UG (limited liability) reserves the right to amend these special provisions (in particular the safety instructions and duties of care contained therein) at any time. The changed special provisions will be communicated to the user in a suitable manner, in particular in electronic form (Internet, app).

Scope of Services and Restrictions
The app and the portal enable the user to access certain information and functions provided by Engineering Maps UG (limited liability). Engineering Maps UG (limited liability) can expand or limit the information and functions available on the app or the portal at any time without prior notice or completely discontinue the service of the app or the portal.

Actual conditions; Assumption of Risk

When using cartographic data or traffic data, directions or other content from Engineering Maps or the map service Openstreetmap, there is a possibility that the results of the map search or the content will differ from the actual conditions. You should therefore act at your own discretion. The use of Engineering Maps or the Openstreetmap map service is at your own risk. You are responsible for your own behavior and its consequences at all times.

Legal status of Engineering Maps UG (limited liability)

Engineering Maps UG (limited liability) is not a party to contracts concluded between users and companies on the portal. Engineering Maps UG (limited liability), its representatives, employees and

Auxiliaries are in no way responsible for the risks associated with initiating and concluding business and are in no way liable for any damage that may result. Engineering Maps UG (limited liability) is not obliged to control the behavior of its users or listed companies in connection with the use of the portal. In particular, Engineering Maps UG (limited liability) is entitled, but not obliged, to use the data on the portal from its users or companies

to check published offers, texts and images for their legality or other admissibility in any way.

Disclaimer of Warranties
Engineering Maps UG (limited liability) does not guarantee that the services will be uninterrupted or error-free, that defects will be corrected, or that the available website & Server is free from viruses and other harmful elements. The user uses this app and the portal at their own risk.

The user is aware that the app or portal is accessed via the Internet. Engineering Maps UG (limited liability) assumes no responsibility and gives no guarantee that the functions of the app and the portal will be uninterrupted or error-free, that access to the app or the portal is possible at any time or that the app or the respective servers are free of viruses or harmful components.

Liability of the user
The user is liable for all consequences resulting from any unauthorized interception of data by third parties.

Links to other websites
The app may contain links to engineering maps or external links. The external information “linked” to the app is completely beyond the control of Engineering Maps UG (limited liability), which is why Engineering Maps UG (limited liability) is responsible for the correctness, completeness and legality of the content as well as for any offers and (services) contained therein assumes no responsibility. Connecting to this information is at your own risk.

Cost
Downloading the app and using the portal is free. Engineering Maps UG (limited liability) also provides the information and functions accessible via the app and the portal free of charge. Paid offers such as additional job offers from companies are clearly identified as such. The user acknowledges that the use of the app may incur costs for downloading data. If necessary, the user clarifies this question with his cell phone provider.

Paid Services

Engineering Maps UG (limited liability) offers fee-based services (hereinafter “fee-based services”) on the Engineering Maps website. This includes posting additional job offers. The amount of the fee for the fee-based services (hereinafter “fee”), the payment terms and the scope and duration of the fee-based services are listed in the app and on the website and are an integral part of the contract between Engineering Maps UG (limited liability) and the user. Relevant at the time of the conclusion of the contract resp. of the contract extension published on the app or on the website.

The fee is due at the time the user places the order and must be paid immediately by the customer unless otherwise specified on the website. The user is in default without further warning from Engineering Maps UG (limited liability).

The validity of paid services that are purchased by the user in connection with a specific usage content expires when this user content is deleted. Refunds of fees are excluded in any case.

Engineering Maps UG (limited liability) is not liable for technical faults, display errors.

Data security during data transmission / data protection
When using the app or the portal, data is transported via an open network that is accessible to everyone. Data can therefore be transmitted across borders, no matter where the user is.

The user acknowledges that due to the open configuration of the Internet or any other communication channels, despite all security measures taken by Engineering Maps UG (limited liability), there is a possibility that third parties at home and abroad could gain unauthorized access to the communication of the user with the IT system of Engineering Maps UG (limited liability). In order to reduce this risk to a minimum, the user uses all available options to protect the mobile devices they use, namely by updating the operating systems used. 

By using the app, Apple Inc. or iTunes S.a.r.l. and/or Google Inc., as well as other manufacturers of mobile devices or network operators, come into possession of certain personal data, which these third parties can view and, if necessary, process further.

The user is recommended to inspect the legal information of these various third parties (e.g. Apple Inc. and Google Inc.), in particular the applicable data protection regulations. 

Username, Password
When you register as a user with the Service, you must create a username, first name, last name, and password for access. When using such login procedures, you agree that Engineering Maps UG (limited liability) collects the personal data. Engineering Maps UG (limited liability) can introduce further means of legitimation or withdraw existing means of legitimation at any time.

1. The personal data of the users are used and collected by Engineering Maps UG (limited liability) in compliance with data protection regulations. The personal data includes the user name, first name, last name and e-mail address, the registration date, gender and the IP address used as well as the fact of participation.

2. The user’s personal data is used as part of the marketing activities of Engineering Maps UG (limited liability) and is not published, but can be passed on to third parties.

Duty of care of the user
Engineering Maps UG (limited liability) will take the measures that are reasonable based on the respective state of knowledge in order to ensure the best possible security of the app and the portal. However, it is essential that the user fulfills the duty of care that applies to him in order to be able to protect himself effectively against misuse. In connection with the use of the app and the portal, the user undertakes in particular to:

• keep his username and password safe and not pass them on to third parties.

• to inform Engineering Maps UG (limited liability) immediately if a third party has at least possibly gained knowledge of the user name and password so that they can block access. 

• not to install any harmful third-party software on the mobile device.

• not to operate the app on a mobile device whose security configuration has at least possibly been manipulated (e.g. through so-called jailbreaking).

• download and install any updates provided by the device manufacturer for the operating system used on the mobile device and the app updates provided by Engineering Maps UG (limited liability) as soon as they are available.

Electronic Communications and the Right to Change Terms
A specific availability of the app or the portal is not guaranteed. In particular, unforeseeable technical problems and maintenance work can lead to downtime and delays.

Engineering Maps UG (limited liability) can change information and functions without giving reasons. In this case, Engineering Maps UG (limited liability) will inform the user about the changes.

Users are not entitled to assert claims against Engineering Maps UG (limited liability) due to such a change.

If you use the Engineering Maps portal, you authorize us to communicate with you electronically, either by email, SMS, push message or through in-app notifications. By accepting these Terms of Use, you agree to receive coupons, special offers, and other notifications in accordance with the Privacy Policy.

The app and portal is for informational purposes. Engineering Maps UG (limited liability) has the right (but has no obligation) to refuse, correct, revise, translate or remove comments or photo uploads from users, as well as to block content or access of certain users.

Engineering Maps UG (limited liability) cannot and will not guarantee that the identities of the users are correct. You agree that Engineering Maps UG (limited liability) shall not be liable for any loss or damage caused by reliance on any information or content contained in conversations.

The app and portal is an internet-based service where certain technical means ensure privacy. Content from your conversations, requests for information, replies, profiles, signatures, qualifications and comments may be disseminated in a one-to-one interaction or in a one-to-many interaction (collective communication). It is not entirely private or confidential, it can be read, collected and used by others. To better protect your privacy, you should be cautious about disclosing confidential information or your contact details.

Prohibited Activities
You represent that content you post on the Site and in Conversations: (1) is not fraudulent, false or misleading; (2) will not violate the property rights, rights of publicity, or privacy of any third party; (3) are not illegal and violate any international, national, provincial or local law, regulation, ordinance or code of ethics in your home country or Germany; (4) not compete with Engineering Maps UG (limited liability) or the Website; (5) are not defamatory, threatening or defamatory; (6); are not obscene or contain child pornography or other material that is harmful to minors; (7) will not be offensive, abusive, discriminatory, harassing, profane or racist; (8) does not contain any virus, Trojan or other computer program routine that will damage or disrupt any system that expropriates data or personal information; (9) will not circumvent, reproduce, attack or compromise the technical security and legal requirements of the website.

Temporary Suspension or Cancellation of Service
You may stop using the app and your account at any time, at your own discretion, by sending an email to info@engineering-maps.com. The cancellation of the service will generally take effect within 7 business days after receipt of the cancellation. At the same time that you closed your account, access to your previous account is terminated.

At any time, without notice, with or without reason, Engineering Maps UG (limited liability) reserves the right to refuse, modify, modify, part or all of the Service and the user account, restrict, temporarily suspend, or terminate.

Property rights of content
You acknowledge that Engineering Maps UG (limited liability) and its licensors (including affiliated companies, partners and suppliers) own the proprietary rights to the App and the Portal and their content. You shall not modify, copy, reverse engineer or attempt to derive the source code of the App. All property rights remain with Engineering Maps UG (limited liability). This reserves all rights to all elements on the app.

Information control and storage
You agree that Engineering Maps UG (limited liability) is not responsible for the deletion of any content or other data/information.

Jurisdiction
Art. 32 ZPO (Code of Civil Procedure)

¹ In the case of disputes arising from consumer contracts is responsible:

a. for consumer claims: the court at the domicile or registered office of one of the parties;

b. for lawsuits brought by the provider: the court at the place of residence of the defendant. < /p>

² Consumer contracts are contracts for services of usual consumption, which are intended for the personal or family needs of the consumer and by the other party within the framework of their professional or commercial activity.

Special provisions for the use of the Engineering Maps app and web application from Engineering Maps UG (limited liability)
You agree that Engineering Maps UG (limited liability) is not responsible for the deletion of any content or other data/information.

Severability clause

If individual provisions of these terms and conditions prove to be ineffective or invalid, the effectiveness or validity of the remaining provisions shall remain unaffected. The invalid provisions are to be interpreted or replaced in a legally permissible manner in a way that most closely corresponds to the intended commercial purpose of the contract.

The use of the app and the information and functions made available through it as well as these terms of use are subject to German law. Exclusive place of jurisdiction is Berlin.
